Terms of Service

These Terms apply to every relationship arising from use of the Service. Any individual rules or notices we separately establish on the Service form part of these Terms. Where these Terms and any individual rules differ, the individual rules prevail.

In these Terms, "Deliverables" means videos, stills, banners, and other outputs we provide to the User through the Service. "Materials" means the product images, video, text, logos, and other assets the User provides to us for production.

Based on the Materials and requirements the User provides, we produce creative such as video, stills, and ad banners. Specific specs, quantities, and deadlines are set at the time of order or by separate agreement. Part of the Service is produced using AI, but we deliver only after a human final check.

A contract for the Service is formed when the User places an order by the method we prescribe and we accept it. We may decline an order where the User is likely to breach these Terms, or in other cases we deem inappropriate.

The fees, payment method, and payment timing for the Service follow what is stated at order or otherwise presented by us. No fee is incurred at the point of application; the fee is fixed when the User agrees to the plan and quote we present. Fixed fees are payable by the method we specify.

We deliver a first draft of the Deliverables within the agreed deadline. The User shall review the content within the period we specify after delivery. If no request for revision is made within that period, the Deliverables are deemed accepted.

We handle revisions to the Deliverables within the number of rounds set in the order or in the plan we present. Revisions beyond that range, or changes that differ significantly from the original requirements, may incur an additional fee.

Rights in the Materials provided by the User belong to the User or the rightful owner. The User warrants that they hold the rights necessary for the Materials, including any third-party copyrights and portrait rights. The ownership and scope of license to the User for Deliverables we produce follow the order or individual agreement.

In using the Service, the User must not engage in any of the following:

• Acts that violate laws or public order and morals
• Acts that infringe the intellectual property, portrait rights, privacy, or other rights of us or any third party
• Providing us with Materials that infringe the rights of a third party
• Acts that interfere with the operation of the Service
• Other acts we deem inappropriate

We may change the content of the Service, or suspend or terminate its provision, without prior notice to the User. Except as otherwise provided in these Terms, we are not liable for any damage thereby caused to the User.

Cancellation of a continuing (subscription) contract shall be requested by the method we prescribe, by the end of the month before the next renewal date. Fees already paid are non-refundable except where the cause is attributable to us.

We make no warranty, express or implied, regarding fitness for a particular purpose or commercial results (such as sales or customer acquisition) in relation to the Service. Except in cases of our willful misconduct or gross negligence, our liability for any damage to the User arising in connection with the Service is capped at the amount the User paid us for the relevant production.

We and the User shall not disclose or leak to any third party, without the other party's prior consent, the business or technical information disclosed by the other party in connection with the Service.

We may change these Terms when we deem it necessary, without notice to the User. The revised Terms take effect from the time we post them on the Service.

These Terms are governed by the laws of the Republic of Singapore. In the event of a dispute between us and the User concerning the Service, the court with jurisdiction over our head office shall be the exclusive court of first instance by agreement.
